Privacy and Cookie Statement – Version 1.0

This Privacy & Cookie Statement is based on the Landsverordening Bescherming Persoonsgegevens (‘LBP’) and wherever required on the General Data Protection Regulation (‘GDPR’) and provides compliance of BearingPoint Caribbean (*) with these data protection laws. It sets out the data protection practices carried out using the Internet and any other electronic communications networks by BearingPoint Caribbean. 

1. Personal Information Collected

BearingPoint Caribbean collects personal data of users:

  • through registration forms;
  • when you send us an employment application;
  • every time you sign up for an electronic newsletter;
  • when you register for an event;
  • when you submit a request for proposal or for information;
  • when you request the authorization of downloading a document;
  • when you enter an online competition; and/or
  • when you send us a message via an email reply mechanism provided on the BearingPoint Caribbean websites. 

2. Lawful reasons for processing personal data

BearingPoint Caribbean may rely on the following lawful reasons when we collect and use personal data to operate our business and provide our products and services: 

  • Contract – We may process personal data in order to perform our contractual obligations.

  • Legitimate interests – We may rely on legitimate interests based on our evaluation that the processing is fair, reasonable and balanced. These include:

3. Use of Personal Data

BearingPoint Caribbean processes personal data collected via the BearingPoint Caribbean websites for the purposes of:

  • providing the services that you request from us;
  • contacting you about your inquiries and requests;
  • recruitment;
  • proposing/inviting to participate in BearingPoint Caribbean’s online communities;
  • proposing/inviting to informational events and conferences;

4. Retention Period of Personal Data

4.1     BearingPoint Caribbean retains personal data to provide services, stay in contact users and to comply with applicable laws, regulations and professional obligations that BearingPoint Caribbean is subject to.

4.2     BearingPoint Caribbean retains personal data for seven years. Unless a different time frame applies because of business need or specific legal, regulatory or contractual requirements in such a case BearingPoint Caribbean will retain personal data in accordance with these uses.

4.3     BearingPoint Caribbean will dispose of personal data in a secure manner when we no longer need it.

5. Data We Gather Automatically and How We Use It

5.1     When you visit one of the BearingPoint Caribbean websites, we collect data automatically about those visits.

5.2     In particular, your browser automatically sends us certain internet-related data, such as the Internet Protocol (IP) address of the computer you are using.

7. Data We Share

We will only disclose personal data to other companies within our group of companies, business partners, government bodies and law enforcement agencies, successors in title to our business and suppliers we engage to process data on our behalf. In these circumstances we will share your personal data for purposes such as our legitimate business purposes and to comply with legal obligations.

8. Links to Other Sites

8.1     This Privacy Statement applies only to data collected by a BearingPoint Caribbean website.

8.2     BearingPoint Caribbean websites contain links to other websites that are not owned or administered by BearingPoint Caribbean. Please be aware that BearingPoint Caribbean is not responsible for the privacy practices of such other third-party websites. We encourage you to read the privacy statements of every website you visit.

9. Security

9.1     BearingPoint Caribbean has put appropriate technical and organizational security policies and procedures in place to protect personal data (including sensitive personal data) from unauthorized disclosure, loss, misuse, alteration or destruction.

9.2     BearingPoint Caribbean aims to ensure that access to your personal data is limited only to those who need to access it. Those individuals who have access to the data are required to maintain the confidentiality of such information.

9.3     BearingPoint Caribbean may apply pseudonymization, de-identification and anonymization techniques in efforts to further protect personal data.

11. International Transfers

Given that the internet is a global environment, using the internet to collect and process personal data necessarily involves the transmission of data on an international basis. We may transfer personal data to BearingPoint Caribbean servers situated outside Curaçao and to reputable third-party organizations situated inside or outside Curaçao, when we have a business reason to engage these organizations. Each organization is required to safeguard personal data in accordance with our contractual obligations and data protection legislation.

We reserve the right to amend this Privacy Statement at any time without advance notice in order to address future developments of BearingPoint Caribbean, the website or changes in industry or legal trends. We will post the revised Statement on the website or announce the change on the home page of the website. You can determine when the Privacy Statement was revised by referring to the “Last Updated” date on the top of this Statement. Any changes will become effective upon the posting of the revised Privacy Statement on the website. If you do not agree with the terms of this Privacy Statement, in whole or part, you can choose to not use the website.
